Casella Wines 2011 Rural Women's Award - Terms and Conditions

- Instructions on “How to Enter” on the Casella Wines website, in the August edition of Australian Women’s Weekly and in five Rural Press publications in August form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- The competition is open to all residents of Australia aged 18 years and over except employees of Casella Wines Australia, their immediate families and agencies associated with this promotion. This promotion will be running in The Australian Women’s Weekly Magazine and five Rural Press newspapers – The Land, Stock Journal, Stock & Land, Queensland Country Life and Farm Life.
- The 2011 Casella Wines Rural Women’s Award promotion commences at 00:01am AEDST on 1 August 2011 and closes 16 September 2011 at 23:59pm AEDST (“Promotional Period”).
- To enter, individuals must during the Promotional Period:
(a) send a letter to the following address and in 200 words or less “tell us why you or someone you know is the deserving winner of the 2011 Casella Wines Rural Women’s Award” and send your entry to:
- Casella Wines Rural Women’s Competition, Units 506-510, Lvl 5, 460 Pacific Highway, St Leonards, NSW 2065
(b) OR Enter on line via the website, www.casellawines.com and follow the prompts.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Incomplete, indecipherable, or illegible entries will be deemed invalid.
- Only one (1) entry permitted per person.
- This is a game of skill and chance plays no part in determining the winners. This promotion will be judged by a panel of judges appointed by the Promoter. Each entry will be individually judged based on literary and creative merit as determined by the judges in their absolute discretion. The judge’s decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into in respect to any such decision.
- Judging will begin on 17 September 2011 at the Promoter’s premises. Winner will be notified by phone using contact details provided in their entry.
- The best entries determined by the judges will win the following:
(a) 1st Prize $10,000 payable by cheque
(b) 2nd, 3rd, 4th and 5th Prize is $2,000 each payable by cheque.
- The Total prize pool is $20,000.
- If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize of equal or greater value and/or specification.
- Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter including but not limited to if a prize winner is unable to be contacted, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
- By submitting an Entry to the Promoter, you grant the Promoter and its licensees and assignees a non-exclusive licence to exercise all rights in perpetuity throughout the world in the Entry and all other material provided by you to the Promoter at any time.
- Without limiting the rights granted to the Promoter under point 15, you specifically agree that point 15 grants to the Promoter the non-exclusive right throughout the world to communicate the Entry in whole or in part to the public on any media platform and you grant to the Promoter all associated rights necessary to exercise the above rights.
- You warrant that:
(a) Details provided with your Entry are true and accurate;
(b) Your Entry is an original work;
(c) You are the copyright owner or authorised licensor of all copyright works and subject matter comprising the Entry; and
(d) The exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties; and you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.
- You agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee paid to you.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) redemption of the prizes. And/or (g) participation in the promotion.
- All entries submitted become the property of Casella Wines. Entries will not be returned to any entrant. By entering this promotion each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoter is entitled to use any of the entries submitted for any purposes at its discretion, including (but not limited to) for any future promotion, marketing and publicity purposes.
- By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
- The collection, use and disclosure of personal information provided in connection with this competition is governed by The Privacy Notice (see contents page for location in this issue).
- The Promoter is Casella Wines Pty Limited (ABN 96 060 745 315) of Farm 1471 Wakley Road, Yenda NSW 2681.
